These Terms of Service ("Terms") govern your access to and use of CitationRadar (citationradar.pro, the "Service"), provided by [OPERATOR NAME -- e.g. "[Your Legal Name], an individual operating under the name CitationRadar, based in Taiwan" or a registered company name once one exists] ("we," "us," or "our").
By creating an account, subscribing to a paid plan, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
CitationRadar aggregates publicly published restaurant health-inspection data from government sources -- currently the New York City Department of Health and Mental Hygiene (DOHMH) and Toronto Public Health (DineSafe) -- and lets subscribers search it and receive email alerts when new violations match filters they choose.
The Service is a lead-generation and monitoring tool. It is not an inspection service, a compliance certification, a legal or regulatory record of any establishment’s current status, or a guarantee that any business identified through the Service wants or needs the subscriber’s products or services.
The Service is intended solely for commercial and business use by companies and individuals operating in fields such as pest control, commercial cleaning, refrigeration/HVAC services, and food-safety or restaurant consulting, or other businesses with a comparable legitimate interest in this data. It is not intended for personal, household, or consumer use.
By creating an account or subscribing, you represent that you are acquiring access to the Service for business purposes and not as a consumer. Where applicable law provides rights or remedies specific to consumer transactions (such as a cooling-off or right-of-withdrawal period), you acknowledge those rights do not apply to a business-to-business subscription of this kind.
You must provide accurate registration information and keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly at the contact address below if you believe your account has been accessed without authorization.
CitationRadar offers a Free plan (limited to one saved search and a periodic email digest) and a paid Pro plan, at the price displayed on our pricing page at the time of purchase. Pricing shown on the Service is introductory and may change; we will give notice before any change takes effect for an existing subscriber’s renewal.
Paid subscriptions are billed through Paddle.com Market Limited, acting as our authorized reseller and merchant of record. Paddle handles payment processing, invoicing, and sales tax/VAT collection for these transactions; your payment information is provided to and held by Paddle, not by us. Paddle’s own terms govern the payment transaction itself.
Subscriptions renew automatically at the then-current price until cancelled. You may cancel at any time from your account dashboard; cancellation takes effect at the end of the current billing period, and we do not provide prorated refunds for partial periods except where required by law or as we otherwise state at the time of purchase.
All inspection, violation, and establishment data made available through the Service originates from third-party government open-data sources that we do not control, operate, or verify. That data can be incomplete, delayed in publication relative to when an inspection actually occurred, miscategorized, or simply wrong, and it can change or be corrected by the originating government agency after we have already shown or alerted you to it.
We do not guarantee the accuracy, completeness, timeliness, or current validity of any data shown through the Service, including whether a listed violation has since been resolved, whether an establishment is still operating, or whether any contact information shown is current. THE SERVICE AND ALL DATA MADE AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE." You are responsible for independently verifying any information before relying on it for a business decision or before contacting any establishment identified through the Service.
If you are the owner or an authorized representative of an establishment listed through the Service and believe a record is inaccurate, out of date, or should no longer be shown, you may submit a request at citationradar.pro/data-removal. We check the business name and address you submit against our records and review each request individually before approving it; requests are not applied automatically. See our Privacy Policy for more detail on this process and how we verify a request.
Approving a request stops that establishment from appearing in future search results, alerts, and exports going forward. It does not retroactively alter or recall any email, export, or record a subscriber already received before approval, and it has no effect on the originating government agency’s own public records.
The Service identifies businesses that may be experiencing a health-code violation; it does not contact them on your behalf, and using it does not by itself make any outreach you send lawful. If you contact an establishment identified through the Service -- by phone, email, mail, or otherwise -- you are solely responsible for complying with all applicable laws governing that outreach, including but not limited to telemarketing, anti-spam, and commercial-solicitation laws in the recipient’s jurisdiction (for example, U.S. federal and state telemarketing and CAN-SPAM rules, and Canada’s Anti-Spam Legislation (CASL) for Toronto-area contacts).
You agree not to use the Service to harass, deceive, or misrepresent your relationship with any establishment, and not to represent that any communication you send is from us or is endorsed by us.
The Service’s software, design, compiled datasets, and any original text or analysis we add to the underlying public data are our property or that of our licensors. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your own internal business purposes during an active subscription. You may not resell, systematically scrape, or republish data obtained through the Service as a competing product.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY LEAD IDENTIFIED THROUGH THE SERVICE WILL RESULT IN A SALE OR ANY OTHER BUSINESS OUTCOME.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, HOWEVER ARISING AND REGARDLESS OF THE THEORY OF LIABILITY, WILL NOT EXCEED THE TOTAL SUBSCRIPTION FEES YOU ACTUALLY PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US$100) IF YOU WERE ON THE FREE PLAN AT THAT TIME.
IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, OR DATA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
The limitations in this section do not apply to any liability that cannot be excluded or limited under applicable law.
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Service in violation of these Terms, your outreach to any establishment identified through the Service, or your violation of any applicable law in connection with your use of the Service.
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if we reasonably believe you have violated these Terms, engaged in unlawful outreach using data from the Service, or otherwise misused the Service. Sections of these Terms that by their nature should survive termination (including Sections 6, 10, 11, 12, and 16) will survive.
We may update these Terms from time to time. If we make a material change, we will post the revised Terms on this page with an updated "Last updated" date and, where practical, notify active subscribers. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Taiwan, without regard to its conflict-of-laws principles. You and we agree that the courts of [Taiwan Court/City -- e.g. the Taiwan Taipei District Court] shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where applicable law requires otherwise.
Nothing in this section limits any right you may have under mandatory consumer-protection or data-protection law of your own jurisdiction that cannot lawfully be waived by contract.
Questions about these Terms can be sent to support@citationradar.pro.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service.
